This Privacy Policy (the "Policy") describes how we at Foggy Bay Photos handle the information we collect from you when you visit our websites (the "Sites") and when you use our services (the "Services"), including purchasing photos or photo-related products. By using the Sites or Services, you agree to the terms of this Policy. We may update this Policy at any time; changes take effect upon posting.

Information We Collect

Foggy Bay Photos does not directly collect or store payment information, full names, addresses, email addresses, or credit or debit card details. All payment transactions are processed securely by Stripe, Inc., our third-party payment processor. Stripe collects and stores your payment and billing information directly, subject to their own privacy policy.

Foggy Bay Photos may receive limited information from Stripe following a transaction — such as your name or email address — solely for the purpose of fulfilling your order and communicating with you about your photos. We also collect contact information when you submit it to join our mailing list or to receive other communications from us.

Foggy Bay Photos may also receive information when you participate in an event that one of our Partners is covering, which might include your timing and finish information for a race or photos at an event.

Non-Personal Information & Cookies

Through the Sites, we also collect non-personally identifiable information relating to your use of the Sites — aggregated, demographic, or other information that does not reveal your specific identity. This is passively collected via browser tools such as cookies.

A "cookie" is a small text file stored on your device when you visit a website. We use cookies to identify your session, customize your experience, generate analytical data, and support advertising and remarketing on third-party websites. Foggy Bay Photos does not currently respond to "Do Not Track" signals.

Responding to Requests

We use information about you to respond to your requests — to fulfill purchases, send publications or other information, and to answer your questions.

Foggy Bay Photos may use email addresses to contact users individually. If you join our mailing list or otherwise provide your contact information, we may send you newsletters or other notices about our Services and products. We may use your information for internal purposes such as data analysis, audits, enhancing the Sites, identifying usage trends, and determining the effectiveness of our promotional messaging.

Payment Processing

All payment transactions are handled directly by Stripe, Inc. Foggy Bay Photos does not receive, store, or have access to your full credit or debit card details. Please review for details.

We may share limited information with unaffiliated third parties who provide services such as order fulfillment, technology, or data analysis. Such providers are only authorized to use your information to the extent necessary to perform services on our behalf.

Operational Partners

We may share information with operational partners — such as entities that host events where we take photographs — so they may contact you about future events or inform you about their products or services. If you would prefer we not share your information in this way, please contact us at .

Business Transfers

In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Foggy Bay Photos or its assets, we may transfer any information we collect to the acquiring party or assignee.

The Foggy Bay Photos site may contain links to other websites. The privacy policies of those sites may differ from ours. Foggy Bay Photos is not responsible for the privacy policies and practices of any linked website. We encourage you to read the privacy policy of any website you visit.

Security

To secure Site integrity, Foggy Bay Photos employs measures including security audits, use of encryption tools and software, and other reasonable security measures and procedures. Foggy Bay Photos does not collect or store credit card numbers or full payment details — all such information is handled exclusively by Stripe, Inc.

Internal access to users' information is restricted to site administrators and individuals on a need-to-know basis.

Use of the Site by Minors

The Sites are not directed to individuals under the age of sixteen (16), and we do not knowingly collect information directly from minors under age 16. If you are under age 16, please do not submit any personal information to us.

Foggy Bay Photos photographs participants at sporting events including triathlons, running races, and similar events, which may include youth athletes. In such cases, it is the responsibility of the parent or legal guardian to register for, purchase, or otherwise interact with our Services on behalf of a minor participant. By completing a purchase or account registration involving a minor, a parent or guardian represents that they have the authority to do so and agrees to this Policy on the minor's behalf.

If you are a parent or guardian and believe we may have inadvertently collected information directly from a child under age 16, please contact us at and we will take prompt steps to delete that information.

Biometric Data Policy

Important

Foggy Bay Photos uses facial recognition technology to help athletes find their event photographs. We are committed to protecting your biometric data and have instated the following policy.

Biometric Data Defined

Biometric data means any biological characteristics of a person, or information based upon such a characteristic, including characteristics defined as "biometric identifiers" and "biometric information" under the Illinois Biometric Information Privacy Act (740 ILCS 14/1, et seq.). This includes retina or iris scans, fingerprints, voiceprints, or scans of hand or face geometry.

How We Use Facial Recognition Technology

When the face search feature is used, our system analyzes a reference photo to generate a mathematical representation (called a "centroid") that captures the geometric relationships between facial features. This centroid — not the original image or a full facial embedding — is the only biometric-derived data retained for matching purposes.

Full facial embeddings and raw biometric data are not stored on our servers. The centroid is used solely to match you to photos taken at events where you participated, and for no other purpose.

Collection, Storage, Use, and Transmission

Foggy Bay Photos collects, stores, uses, and/or transmits biometric data solely for identity verification to use, access, and purchase items from Foggy Bay Photos. We will not sell, lease, or trade to third parties any biometric data received from users.

Biometric Data Storage

Foggy Bay Photos shall use a reasonable standard of care to store, transmit, and protect from disclosure any biometric data collected, in a manner that is the same as or more protective than how we store other personal information. Any biometric information collected will be permanently destroyed within three years after collection.

Your Right to Delete Biometric Data

You have the right to request deletion of any biometric data, including centroids, that Foggy Bay Photos holds relating to you. To submit a deletion request, please email us at . We will process your request as soon as reasonably practicable.

Disclosure

Foggy Bay Photos will not disclose, disseminate, or transmit any client's biometric data to any person or entity other than the client, unless required by law.

Cross-Event Data Policy

Our Commitment

Foggy Bay Photos does not build cross-event identity profiles. Your data — including face data, bib information, and purchase history — is scoped to the individual event where it was collected and is never combined into a unified profile across events.

Event-Scoped Face Data

Facial recognition data (centroids) generated when you use our face search feature is stored per event. A centroid created to find your photos at one race is not linked to, combined with, or used to identify you at any other event. Each event's face data is isolated in our systems.

Event-Scoped Bib and Timing Data

Bib numbers and timing data are specific to a single event and are not cross-referenced with your participation in other events covered by Foggy Bay Photos.

Purchase Records

If you have purchased photos at more than one event, those orders are stored as separate, independent records associated with that event. We do not link your purchase history across events to build a profile of your activity or preferences.

My Favorites

The My Favorites feature uses your email address to retrieve photos you have saved within a specific event. Your email is used solely to look up those saved photos and is not used to link your identity or activity across multiple events.
